2. Scope
These Terms of Sale apply to purchases of the “Nicepage Cookie & Consent Advanced for Joomla” plugin through dg-media.com. They apply to consumers and business customers. Any conflicting customer terms apply only if expressly accepted by the Seller in writing.
3. Product and contract conclusion
The product is a digital Joomla plugin supplied by download. The product page and checkout are an invitation to place an order. By clicking the PayPal purchase button, the customer submits a binding order. The contract is concluded when the PayPal payment is successfully captured and the order confirmation is displayed or sent by email.
4. Price and taxes
The net price is EUR 25.00. The applicable VAT and the final total are shown before the customer confirms payment. Tax treatment depends on the billing country, customer status and, where relevant, a valid EU VAT identification number. The customer must provide complete and accurate billing and tax information.
5. Payment and digital delivery
Payment is made through PayPal. After successful payment, the download is made available immediately and a download link is sent to the email address supplied during checkout. The link remains valid for 48 hours and may be used repeatedly during this period. The customer is responsible for providing a valid email address and storing the downloaded installation package. A commercial invoice is issued separately by the Seller.
6. Right of use
The customer receives a non-exclusive, non-transferable right to install and use the plugin for the customer’s own websites and website projects. The plugin or its download access may not be resold, redistributed, published, shared with third parties as a standalone product, or offered for download. Copyright and all other intellectual property rights remain with the Seller.
7. Updates and product lifetime
The purchase includes access to available updates for as long as the plugin is actively maintained and offered by the Seller. “Lifetime updates” refers to the commercial lifetime of the product, not the lifetime of the customer or Seller. No minimum maintenance period, release frequency or permanent availability is guaranteed.
8. Support and compatibility
The purchase does not include individual support, installation, configuration, customization or legal advice. The customer must check the stated system requirements and compatibility with the customer’s Joomla, Nicepage, PHP and third-party extension versions. Future changes to Joomla, Nicepage, browsers or third-party services may require an update and may temporarily affect compatibility.
9. Consumer right of withdrawal
For consumers, the statutory right of withdrawal generally applies. Before immediate digital delivery begins, the customer is asked to expressly consent to performance beginning before the withdrawal period expires and to acknowledge that the right of withdrawal is lost once performance has begun, to the extent permitted by applicable law.
10. Legal compliance and customer responsibility
The plugin provides technical consent-management functions but does not guarantee that a particular website is legally compliant. Legal compliance depends on the website’s content, configuration, third-party services and the law applicable to the customer. The customer remains responsible for correct configuration, testing and obtaining legal advice where required.
11. Warranty and liability
Statutory warranty rights apply. The Seller is liable without limitation for intent and gross negligence, for injury to life, body or health, and where liability is mandatory by law. For slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable damage typical for the contract. Mandatory consumer rights remain unaffected.
12. Customer obligations
Before installation or update, the customer must create a current backup and test the plugin in a suitable environment. Access credentials and download links must be protected against unauthorized use.
13. Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protections provided by the law of their habitual residence. If the customer is a merchant, a legal entity under public law or has no general place of jurisdiction in Germany, the Seller’s registered place of business is the agreed place of jurisdiction.
14. Final provisions
If any provision is invalid or unenforceable, the remaining provisions remain unaffected. Mandatory statutory provisions take precedence.
